Terms of Service

These Terms of Service ("Terms") set the conditions for using the iPhone app "miiLink", the public pages made with it, and this website (together, the "Service"), provided by 山口穣之 ("we", "us"). By using the Service you agree to these Terms. If the Japanese version and this English version differ, the Japanese version prevails.

1. Definitions

  1. A "public page" is the page you make with the Service, which anyone can open at your own URL.
  2. "Your content" is everything you add to the Service: display name, bio, profile image, link titles and URLs, social icons, your ID and anything else.
  3. "miiLink PRO" is the one-time paid upgrade described in section 9.

2. Your account

  1. Accounts are created with Sign in with Apple.
  2. You are responsible for your account and must not let anyone else use it.
  3. If you are a minor, get permission from a parent or guardian before using the Service.
  4. Each account has one public page.

3. Your ID

  1. Your ID becomes part of your page URL. IDs are 3–20 characters (letters, numbers and underscores) and are first come, first served.
  2. Reserved words, inappropriate words, and IDs that could be mistaken for another person's name, a trademark or a service are not available. We may ask you to change, or suspend, an ID that falls into these groups, even after you have claimed it.
  3. IDs cannot be sold, transferred or lent.

4. Your content

  1. You, or the rightful owner, keep the rights to your content.
  2. You give us a free licence to use your content as needed to run, show and improve the Service: storing, copying, resizing, showing it on your public page and in preview images, and letting search engines list it. The licence ends when you delete your account.
  3. You confirm that you have the rights your content needs and that it does not infringe anyone else's rights.
  4. You are responsible for your content and for the sites you link to.

5. What is not allowed

Your public page, your content and the sites you link to must not include or involve:

  1. Adult or sexual content, or links to sites mainly for it (including promotion of sexual services and obscene images or text)
  2. Gambling or betting, or anything that steers people towards it (including paid betting tips)
  3. Dating, hook-ups, "sugar" arrangements or any other solicitation of that kind
  4. Scams, phishing, pyramid or multi-level schemes, get-rich-quick or investment pitches, and false or exaggerated advertising
  5. Malware, harmful software, or links to sites that try to break into people's devices or accounts
  6. Hate speech or discrimination based on race, ethnicity, nationality, religion, sex, sexual orientation, disability or similar, and threats, harassment or bullying
  7. Encouraging violence or self-harm, trading illegal drugs or weapons, or anything else that breaks the law or public order
  8. Impersonating a person or organisation, or suggesting a connection that does not exist
  9. Using other people's copyrighted work (art, photos, logos, text), trademarks or likeness without permission, or linking to pirated material
  10. Posting someone else's personal information (such as their address or phone number) without their consent
  11. Overloading our servers or network, creating accounts or sending requests in bulk by automated means, or abusing the report feature
  12. Getting in the way of the Service, or anything else we reasonably consider inappropriate

6. Hiding and deleting pages

  1. If we decide that a public page or any of your content breaks, or may break, these Terms, we may hide the page, delete the content, and suspend or delete the account without notice.
  2. Links are checked automatically when you save them, so links to dangerous URLs or prohibited sites may be refused.
  3. We do not have to explain the reason for these actions, and we are not liable for losses they cause you.

7. Reports

  1. Every public page has a Report link. Anyone can report a page that breaks these Terms with that link or through the contact on the Support page.
  2. We review reports within 24 hours of receiving them as a rule, and take the actions in section 6 where needed.
  3. A page that receives a certain number of reports may be hidden automatically until the review is done.
  4. To report an infringement of your rights, email us the URL of the page and information that shows you hold the rights.

8. Ads

On the free plan, ads appear in the app and on public pages. Ads are chosen by the ad networks and we do not vouch for them. We block categories such as gambling, dating and adult content in our ad settings.

9. miiLink PRO

  1. miiLink PRO is a one-time purchase (¥560 in Japan; the App Store shows the price in your country) that removes ads, unlocks all themes and hides the miiLink logo on your public page. There is no subscription.
  2. Purchases and payments go through Apple's App Store, under Apple's terms.
  3. Refunds are requested from Apple, through Apple's process. We do not receive your payment directly, so we cannot issue refunds ourselves.
  4. With the same Apple ID you can use "Restore purchase" in the app's settings, for example after changing phones.
  5. miiLink PRO works for as long as the Service is offered. It ends if you delete your account or if we delete it for breaking these Terms.

10. Deleting your account

  1. You can delete your account at any time from the app's settings.
  2. This deletes your public page, your content, images and view counts. It cannot be undone. A deleted ID may later become available to others.
  3. Deleting your account does not refund an App Store purchase.

11. Changes to the Service

We may change the Service, or pause it for maintenance or outages, without notice. If we shut the Service down, we will announce it in the app or on this website a reasonable time in advance.

12. Disclaimers and liability

  1. We do not promise that the Service will suit your purpose, always be available, be free of bugs, or bring your page any particular number of views or results.
  2. Sites linked from public pages belong to others; we are not responsible for what they contain or how safe they are.
  3. Disputes between users, or between a user and someone else, are for those people to settle.
  4. Except in cases of our intent or gross negligence, our liability is limited to ordinary, actual losses and capped at the amount you paid us for the Service. Where the law (such as Japan's Consumer Contract Act) does not allow this limit, it does not apply.

13. Changes to these Terms

We may update these Terms. We will post the new text and the date it takes effect on this page, and announce important changes in the app. Using the Service after that date means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Japan. The district court with jurisdiction over our location has exclusive jurisdiction in the first instance.
